These Terms and Conditions govern your access to and use of picks.ae, including purchases made through the website.

Picks is operated by Awadsons Technologies in the United Arab Emirates.

By accessing this website, creating an account, placing an order, or requesting a Custom Order, you agree to these Terms and Conditions together with our:

  • Refund and Returns Policy
  • Privacy Policy
  • Shipping and Delivery Policy
  • Any product-specific or Custom Order terms presented before purchase

2. Eligibility to purchase

You must be at least 18 years old and legally capable of entering into a binding agreement to place an order.

By placing an order, you confirm that:

  • The information you provide is complete and accurate.
  • You are authorised to use the selected payment method.
  • You are purchasing for lawful purposes.
  • You have reviewed the product details and applicable policies.
  • You are legally capable of entering into the purchase contract.

We may refuse or cancel an order where we reasonably believe that these requirements have not been met.

3. Products and services

Picks offers automotive collectibles and related products and services, including:

  • New collectible models.
  • Pre-owned or previously opened models.
  • Rare, limited, discontinued, or condition-disclosed products.
  • Modified or curated products.
  • Custom Orders and commissioned work.
  • Associated display, presentation, and packaging components.

Products may vary in availability, condition, manufacturer, scale, edition, material, specification, packaging, and included accessories.

The product page forms part of the purchase terms for that product.

4. Product information

We take reasonable care to ensure that product descriptions, images, specifications, prices, condition statements, and availability are accurate.

However:

  • Colours may differ slightly because of lighting, photography, screen settings, or manufacturer production variation.
  • Dimensions and specifications may contain reasonable manufacturing tolerances.
  • Diecast products may show minor manufacturer variations in paint, decals, panel alignment, wheel alignment, trim, fittings, packaging, or assembly.
  • Packaging may vary between manufacturer production batches.
  • Product images may include styling, backgrounds, props, or display items not included with the purchase unless expressly stated.

A minor variation that does not materially affect the product’s identity, function, stated condition, or value is not automatically a defect.

Nothing in this section limits your rights where a product is materially misdescribed or materially different from what was ordered.

5. Pre-owned and condition-disclosed products

Some products may be described as:

  • Pre-owned.
  • Previously opened.
  • Previously displayed.
  • Modified.
  • Supplied without complete manufacturer packaging.
  • Supplied with packaging wear.
  • Showing disclosed cosmetic or manufacturing imperfections.

We will disclose material condition issues that we reasonably identify before sale.

By purchasing a condition-disclosed product, you accept the condition points clearly stated or shown on the product page. This does not remove your rights regarding undisclosed material defects, incorrect supply, or material misdescription.

6. Collectible packaging

For collectible products, the manufacturer packaging, display base, certificates, inserts, accessories, serial information, protective materials, and Picks presentation materials may form part of the product and its value.

Customers should review the product listing carefully to confirm what packaging and accessories are included.

Where original packaging is unavailable, damaged, replaced, or incomplete, this will be disclosed where reasonably identifiable.

7. Prices

All prices are displayed in United Arab Emirates dirhams (AED) unless otherwise stated.

Prices displayed on the website:

  • Apply at the time the order is submitted.
  • May change without prior notice before an order is accepted.
  • Exclude delivery charges unless expressly stated otherwise.
  • Include or exclude any applicable tax as indicated during checkout and on the invoice.
  • May differ from prices offered through other sales channels.

The complete order total, including applicable delivery charges and taxes, will be shown before payment.

We will not add undisclosed payment or delivery charges after the order is submitted. UAE modern technology-based trade rules require prices, logistics charges, payment costs, and contractual conditions to be made available to the customer.

8. Pricing and listing errors

We may correct an obvious pricing, stock, description, or technical error before accepting an order.

If an error affects an order already submitted, we will contact you and provide the option to:

  • Proceed with the corrected information.
  • Select an alternative product.
  • Cancel the affected order for a full refund.

We will not deliberately use misleading pricing or product information.

9. Placing an order

When you submit an order, you are making an offer to purchase the selected product under these Terms and Conditions.

After submission, you may receive an automated acknowledgment. This confirms that we received your order but does not necessarily mean that the order has been accepted.

A binding purchase contract is formed when we:

  • Confirm that the order has been accepted; or
  • Dispatch the product,

whichever occurs first.

For Custom Orders, the contract may instead begin when the customer approves the quotation or specification and pays the stated deposit or amount.

10. Order acceptance

We may decline or cancel an order before acceptance where reasonably necessary, including when:

  • The product is unavailable.
  • Stock information is incorrect.
  • There is an obvious pricing or description error.
  • Payment is declined, reversed, or flagged.
  • We cannot verify customer or delivery information.
  • We suspect fraud, misuse, unauthorised resale, or unlawful activity.
  • Delivery cannot reasonably be completed.
  • The order breaches these Terms and Conditions.
  • A technical error affected the transaction.

Where payment has already been collected for an order that we cannot accept, the amount will be refunded to the original payment method.

11. Product availability

All orders are subject to availability.

Rare, limited, discontinued, pre-owned, modified, or one-off products may have only one unit available. A product appearing on the website does not guarantee that it remains available until the order is accepted.

We are not required to source an alternative product where a product becomes unavailable, but we may offer one at our discretion.

12. Payment

Payment must be completed using a payment method available at checkout.

Payments may be processed by third-party payment providers. By using a payment method, you may also be subject to the payment provider’s applicable terms and privacy practices.

You confirm that:

  • You are authorised to use the payment method.
  • The billing details supplied are accurate.
  • Sufficient funds or credit are available.
  • The payment is not fraudulent or unlawful.

We do not guarantee that a payment provider will approve a transaction.

Unless clearly disclosed before payment, Picks will not impose an additional fee solely because you use a digital payment method. UAE rules prohibit undisclosed digital-payment charges.

13. Security and payment verification

To protect customers and Picks, we may request reasonable verification before accepting or dispatching an order.

Verification may include confirmation of:

  • Customer identity.
  • Billing information.
  • Delivery information.
  • Payment authorisation.
  • Transaction authenticity.

An order may be delayed or cancelled where verification cannot reasonably be completed.

14. Invoices

Customers will receive an electronic order confirmation, receipt, or invoice containing the transaction details.

UAE consumer-protection and modern technology-based trade rules require providers to issue transaction information showing the trader, product, quantity, price, and other prescribed details.

Please retain your order confirmation and invoice as proof of purchase.

15. Shipping and delivery

We currently deliver only to destinations made available during checkout.

Available delivery regions, rates, estimated delivery periods, and restrictions will be shown through the website or our Shipping and Delivery Policy.

Delivery estimates are not guaranteed delivery dates unless expressly confirmed in writing.

Delivery may be affected by:

  • Courier delays.
  • Incorrect or incomplete delivery information.
  • Customer unavailability.
  • Security or access restrictions.
  • Public holidays.
  • Weather or transport disruption.
  • Events beyond our reasonable control.

We will take reasonable steps to communicate material delays.

16. Delivery information

You are responsible for providing a complete and accurate:

  • Recipient name.
  • Mobile number.
  • Email address.
  • Building or villa information.
  • Street and area.
  • Emirate.
  • Access instructions where relevant.

We are not responsible for delays or additional delivery costs caused by inaccurate or incomplete information supplied by the customer.

Additional costs caused by redelivery, refusal, customer absence, or incorrect address information may be charged where they are reasonable and disclosed before redelivery.

17. Inspection upon delivery

Please inspect the shipping carton and product promptly after delivery.

Where there is visible damage, an incorrect product, a missing component, or another material issue, contact:

Provide the order number and clear photographs or video of:

  • The shipping carton.
  • Delivery label.
  • Manufacturer packaging.
  • Product.
  • Relevant damage or issue.

Please retain all packaging until the claim has been reviewed.

18. Risk during delivery

Picks remains responsible for fulfilling the order in accordance with the applicable purchase terms and UAE law.

Nothing in these Terms transfers responsibility to the customer in a way that unlawfully limits rights concerning products damaged, lost, or incorrectly supplied during delivery.

19. Order cancellation

A standard order may be cancelled before dispatch where fulfilment has not progressed beyond a point at which cancellation is no longer reasonably possible.

Once dispatched, the order will be handled under our Refund and Returns Policy.

Submitting a cancellation request does not guarantee that dispatch can be stopped.

20. Refunds and returns

All cancellations, returns, exchanges, defects, damaged products, and refunds are governed by our Refund and Returns Policy, which forms part of these Terms and Conditions.

Customers should review that policy before completing a purchase.

Nothing in that policy or these Terms limits any mandatory right available under UAE law.

21. Change-of-mind requests

Eligibility for a change-of-mind return depends on the condition and type of product and is governed by our Refund and Returns Policy.

Opened, displayed, modified, personalised, condition-disclosed, custom, or value-affected collectible products may not qualify for a change-of-mind return where they cannot reasonably be restored and resold in their original condition.

This does not affect remedies for defective, damaged, incorrectly supplied, incomplete, or materially misdescribed products.

22. Defective, damaged, or incorrect products

Where a product is established to be defective, damaged, incomplete, incorrectly supplied, or materially misdescribed, Picks will provide an appropriate remedy in accordance with applicable UAE law.

Depending on the circumstances, this may include:

  • Repair.
  • Replacement.
  • Exchange.
  • Partial refund.
  • Full refund.
  • Another remedy agreed with the customer.

No provision in these Terms excludes mandatory consumer remedies. UAE consumer-protection law prohibits contract terms that harm or unlawfully waive consumer rights.

23. Custom Orders

A Custom Order may include:

  • A specifically sourced model.
  • Design or concept development.
  • Modification.
  • Painting or finishing.
  • Engraving.
  • Personalisation.
  • Numbering.
  • Custom display production.
  • Custom packaging.
  • Commissioned or made-to-order work.

Each Custom Order may be governed by a written quotation, specification, timeline, payment schedule, deposit requirement, and approval process.

Where a Custom Order document conflicts with these general Terms, the specific written and accepted Custom Order terms will apply to that order, except where they conflict with mandatory law.

24. Custom Order approval

The customer is responsible for reviewing and approving the Custom Order specification.

Approval may include confirmation of:

  • Model and scale.
  • Design direction.
  • Colours and materials.
  • Personalisation.
  • Display format.
  • Text, names, dates, or serial information.
  • Budget.
  • Estimated timeline.
  • Permitted production variations.

Work may begin after written approval and receipt of the required payment or deposit.

25. Custom Order changes

Changes requested after approval may:

  • Increase the price.
  • Extend the timeline.
  • Require replacement materials or products.
  • Result in additional sourcing or production charges.
  • Be impossible after certain production stages.

No requested change is accepted until Picks confirms it in writing, including any impact on cost and timing.

26. Custom Order deposits and cancellation

A deposit may become non-refundable to the extent that it covers genuine costs already incurred, including:

  • Sourcing or purchasing.
  • Design work.
  • Materials.
  • Third-party supplier charges.
  • Production.
  • Personalisation.
  • Modification.
  • Custom packaging.

Any deposit, payment stage, cancellation restriction, and committed cost will be disclosed before the Custom Order proceeds.

This section does not remove rights arising from a breach, defect, material nonconformity, or other mandatory legal remedy.

27. Custom Order variations

Custom, handcrafted, modified, or small-production products may show reasonable variations caused by:

  • Materials.
  • Hand finishing.
  • Manufacturing tolerances.
  • Paint application.
  • Screen-to-production colour differences.
  • Component availability.
  • Approved production methods.

Reasonable variations that remain materially consistent with the approved specification are not automatically defects.

28. Estimated Custom Order timing

Custom Order completion dates are estimates unless expressly agreed as fixed in writing.

We will communicate material delays and may propose an updated completion date.

Where a delay materially affects the purpose of the order, the parties will seek a fair remedy consistent with the accepted Custom Order terms and applicable law.

29. Limited, one-off, and Founder Edition products

Limited, numbered, one-off, modified, or Founder Edition products may not be reproducible or replaceable.

Where an identical replacement is unavailable, the appropriate remedy for a valid claim may include repair, partial refund, full refund, or another mutually agreed solution, subject to applicable law.

Scarcity does not remove the customer’s mandatory rights.

30. Manufacturer warranties

Some products may include a manufacturer warranty or manufacturer-provided rights.

Any manufacturer warranty is separate from the customer’s mandatory rights against Picks as the seller.

Where applicable, warranty details will be supplied with the product or made available through the manufacturer.

31. Promotions and discount codes

Promotions and discount codes:

  • Apply only during the stated period.
  • May be limited to selected products or customers.
  • Cannot be exchanged for cash.
  • May not be combined unless expressly allowed.
  • May be withdrawn or corrected where issued in error or misused.
  • Remain subject to stock availability.

Promotional restrictions will not remove mandatory rights concerning defective, damaged, or misdescribed products.

32. Gift purchases

The purchaser remains responsible for ensuring that the product, scale, condition, and delivery information are suitable for the intended recipient.

Refunds will normally be issued to the original payment method used by the purchaser.

Any gift-specific arrangements will be stated during checkout or agreed in writing.

33. Customer accounts

You may be permitted to create a customer account.

You are responsible for:

  • Keeping login details confidential.
  • Using accurate account information.
  • Preventing unauthorised access.
  • Informing us promptly of suspected misuse.

We may suspend or close an account where necessary to protect customers, Picks, or the website from fraud, abuse, security threats, or unlawful activity.

34. Acceptable website use

You must not:

  • Use the website unlawfully or fraudulently.
  • Attempt unauthorised access to the website, server, accounts, or data.
  • Introduce malware or harmful code.
  • Interfere with website operation or security.
  • Scrape or systematically copy content without permission.
  • Submit false orders, reviews, claims, or payment information.
  • Impersonate another person.
  • Use Picks content or branding in a misleading manner.

We may restrict access where these Terms are materially violated.

35. Reviews and submitted content

Where the website permits reviews, photographs, comments, or other content, you confirm that your submission:

  • Is truthful and based on genuine experience.
  • Does not violate another person’s rights.
  • Is not unlawful, defamatory, discriminatory, threatening, or misleading.
  • Does not contain malware, advertising spam, or confidential information.

You grant Picks a non-exclusive right to display and reproduce submitted content for operating and promoting the website, subject to applicable privacy and intellectual-property laws.

We may remove content that breaches these requirements.

36. Intellectual property

All rights in the Picks website and brand materials belong to Awadsons Technologies, Picks, or their respective licensors.

Protected materials may include:

  • The Picks name.
  • The Vanguard emblem.
  • Logos and wordmarks.
  • Website design.
  • Photography.
  • Videos.
  • Product presentation.
  • Written content.
  • Graphics.
  • Custom concepts.
  • Packaging designs.
  • Custom Order designs.

You may access the website for personal, non-commercial use.

You must not reproduce, modify, sell, distribute, license, or commercially exploit protected content without prior written permission.

Third-party vehicle, manufacturer, and product trademarks remain the property of their respective owners. Their appearance does not imply sponsorship, endorsement, or official affiliation unless expressly stated.

37. Privacy and personal data

Personal data is handled in accordance with our Privacy Policy and applicable UAE data-protection requirements.

We may use information to:

  • Process orders and payments.
  • Deliver products.
  • Manage customer service.
  • Prevent fraud.
  • Meet legal and accounting obligations.
  • Provide marketing communications where permitted.

38. Marketing communications

UAE modern technology-based trade rules require customers to be given a choice regarding promotional communications.

  • Social media.
  • Manufacturer websites.
  • External content.

We are not responsible for third-party websites or services outside our control. Their own terms and privacy policies may apply.

This does not limit Picks’ responsibility for its own obligations as the seller.

40. Website availability

We aim to keep the website available and secure but do not guarantee uninterrupted or error-free operation.

We may temporarily suspend access for:

  • Maintenance.
  • Security updates.
  • Technical problems.
  • Service-provider disruption.
  • Legal or regulatory requirements.
  • Events beyond our reasonable control.

Confirmed orders remain subject to the rights and obligations applicable to them.

41. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for:

  • Fraud or fraudulent misrepresentation.
  • Death or personal injury caused by negligence where applicable.
  • Deliberate misconduct.
  • Mandatory consumer rights.
  • Any other liability that cannot lawfully be excluded.

Subject to those protections, Picks is not responsible for indirect or consequential losses that were not reasonably foreseeable at the time the purchase contract was formed.

For purchases made for personal consumer use, these Terms do not exclude rights or compensation available under applicable UAE consumer-protection law.

42. Events beyond reasonable control

We are not responsible for delay or failure caused by events beyond our reasonable control, including:

  • Natural disasters.
  • Extreme weather.
  • Government restrictions.
  • Transport disruption.
  • Customs delays.
  • Labour disruption.
  • Public-health emergencies.
  • Telecommunications or infrastructure failure.
  • Cyber incidents not caused by our failure to take reasonable precautions.

We will take reasonable steps to minimise the effect and communicate material delays.

This section does not remove rights that cannot lawfully be excluded.

44. Governing law and disputes

These Terms and Conditions and any purchase made through picks.ae are governed by the applicable laws of the United Arab Emirates.

The parties should first attempt to resolve any dispute directly and in good faith.

Where a dispute cannot be resolved, it may be referred to the competent consumer-protection authority, dispute-resolution body, or court with jurisdiction in the United Arab Emirates.

UAE legislation provides that the competent courts of the State or relevant Emirate may resolve disputes concerning modern technology-based trade.

Nothing in this section prevents a consumer from using any mandatory forum or remedy available under applicable law.

45. Language

These Terms should be made available in Arabic and may also be provided in English.

Where required by UAE law, the Arabic version will be the legally applicable consumer-facing version. UAE consumer-protection law requires consumer data, advertising, and contracts to be provided in Arabic, while allowing other languages alongside it.

46. Changes to these Terms

We may update these Terms to reflect changes in:

  • The business.
  • Products or services.
  • Website functionality.
  • Payment or delivery arrangements.
  • Legal or regulatory requirements.

The updated version will be published with a revised “Last updated” date.

Changes will not retrospectively reduce rights attached to an order already accepted unless required by law or agreed with the customer.

47. Severability

If any provision is found to be invalid, unlawful, or unenforceable, that provision will be applied or adjusted only to the extent legally permissible.

The remaining provisions will continue to apply.

48. No waiver

A delay or failure by Picks to enforce a right does not mean that the right has been waived.

Any waiver must be clear and apply only to the specific matter for which it was given.

49. Entire agreement

These Terms, together with the relevant product page, accepted quotation, Custom Order specification, and linked policies, form the agreement between Picks and the customer regarding the applicable purchase.

Nothing in this section excludes statements or rights that cannot lawfully be excluded.
